Welcome to Endless Skyway Cabin. These Terms & Conditions (“Terms”) govern your access to and use of the [Website Name] website, mobile applications, and related services (collectively, the “Services”) operated by Cedar Hills Trail LLC,” “we,” “us,” or “our”).
The Services provide an online marketplace that may allow property owners, managers, or authorized representatives (“Hosts”) to list short-term accommodations and allow individuals seeking accommodations (“Guests”) to search for, communicate about, and reserve those accommodations.
By accessing or using the Services, creating an account, listing a property, or making a reservation, you agree to these Terms. If you do not agree with these Terms, you may not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction if greater, to create an account, book an accommodation, or list a property.
By using the Services, you represent and warrant that:
you meet the applicable age requirement;
you have the legal capacity to enter into these Terms;
the information you provide is accurate and complete;
you will maintain accurate account information;
you will comply with all applicable laws and regulations; and
you are not prohibited from using the Services under applicable law.
Endless Skyway Cabin operates an online marketplace and does not own, operate, manage, or control every property listed on the Services unless expressly stated otherwise.
Unless specifically identified as the property owner or operator, [Company Name] is not a party to the rental agreement between a Host and Guest.
Hosts are responsible for their properties, listings, availability, pricing, house rules, permits, licenses, taxes, and compliance with applicable laws.
Guests are responsible for reviewing listings and determining whether an accommodation is appropriate for their needs before making a reservation.
We do not guarantee the accuracy, quality, legality, safety, suitability, availability, or condition of any property listed by a Host.
Certain features may require you to create an account.
You agree to:
provide accurate and complete information;
maintain the security of your password and account;
promptly update inaccurate information;
not share your account credentials with others;
not impersonate another person;
not create an account using another person’s identity; and
notify us promptly of unauthorized access to your account.
You are responsible for activity occurring through your account unless you can establish that the activity occurred without your authorization and through no fault of your own.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
Hosts may create listings for properties they own, operate, or are legally authorized to rent.
Hosts agree that all listing information will be accurate and not misleading, including:
property location;
photographs;
descriptions;
amenities;
availability;
pricing;
occupancy limits;
minimum-stay requirements;
cancellation policies;
house rules;
accessibility information;
fees; and
material limitations or restrictions.
Hosts must promptly update listings when information changes.
Hosts may not advertise a property that they are not authorized to rent.
Hosts are responsible for:
complying with applicable federal, state, county, and local laws;
obtaining required permits, licenses, registrations, and approvals;
complying with zoning and short-term-rental regulations;
paying applicable taxes and fees;
maintaining the property in a reasonably safe and habitable condition;
complying with applicable health and safety requirements;
accurately describing the property;
honoring confirmed reservations, subject to these Terms and applicable cancellation policies;
providing Guests with reasonably necessary check-in information;
respecting Guests’ privacy; and
responding reasonably to Guest communications and issues.
Hosts are solely responsible for determining whether they are legally permitted to offer a property as a short-term rental.
Guests agree to:
provide accurate information when making a reservation;
use the property only for lawful purposes;
comply with the Host’s reasonable house rules;
comply with occupancy limits;
treat the property and its contents with reasonable care;
respect neighbors and the surrounding community;
avoid excessive noise or disruptive behavior;
not use the property for unlawful activities;
not engage in unauthorized commercial activity;
not exceed the number of permitted occupants;
not hold unauthorized events or parties;
promptly report material problems or damage to the Host; and
leave the property in reasonably clean and orderly condition, subject to ordinary use.
Guests are responsible for the conduct of individuals they invite onto a property.
Unless expressly authorized by the Host and permitted by law, Guests may not:
hold parties or events;
exceed the property’s occupancy limit;
use the property for illegal activity;
use the property for commercial filming or photography;
use the property as a business location;
engage in harassment, threats, or abusive conduct;
damage or remove property;
interfere with security systems;
circumvent booking or payment procedures;
provide false information;
attempt to access another user’s account;
use the Services for fraudulent purposes;
violate applicable laws or regulations; or
engage in activity that creates an unreasonable risk to people or property.
When a Guest submits a reservation request, the request may be subject to Host acceptance unless the listing provides for immediate booking.
A reservation becomes confirmed when Hospitable.com indicate that the reservation has been accepted and any required payment has been successfully processed.
A confirmed reservation creates an agreement between the Guest and Host concerning the applicable stay, subject to these Terms, the listing, and the Host’s stated rules and policies.
Prices displayed through the Hospitable.com may include:
nightly or other rental rates;
cleaning fees;
service fees;
security deposits;
taxes;
additional guest fees;
pet fees;
other disclosed charges.
The total price presented during checkout will generally include the charges applicable to the reservation at that time.
Hosts are responsible for ensuring that pricing and fees displayed for their listings are accurate.
We reserve the right to correct pricing errors and, where permitted by law, cancel reservations affected by obvious pricing errors.
Payments may be processed by Hospitable.com or third-party payment processors.
By providing payment information, you authorize the applicable payment provider to charge the amounts associated with your reservation.
Hosts authorize us or our payment providers to process applicable payouts according to the payment terms presented through the Services.
We may delay, withhold, or adjust payments when reasonably necessary to address suspected fraud, disputes, chargebacks, cancellations, violations of these Terms, or other legitimate concerns.
Depending on the jurisdiction, taxes may apply to rental transactions.
Taxes may include occupancy, lodging, hotel, sales, transient occupancy, or similar taxes.
Where required, Endless Skyway Cabin may collect and remit applicable taxes on behalf of Hosts.
Where Endless Skyway Cabin does not collect or remit a particular tax, the Host may remain responsible for determining, collecting, reporting, and remitting the tax as required by law.
Hosts and Guests are responsible for their own tax obligations arising from their use of the Services.
Each listing may have its own cancellation policy, which will be displayed during the booking process where applicable.
The cancellation policy applicable to a reservation will generally determine whether a Guest receives a full refund, partial refund, credit, or no refund.
Cancellation policies may be subject to applicable law and any mandatory consumer protections.
Guests should carefully review the cancellation policy before completing a reservation.
Hosts should honor confirmed reservations.
If a Host must cancel a confirmed reservation, the Host may be subject to consequences established by Endless Skyway Cabin, which may include:
cancellation fees;
withholding or adjustment of payouts;
suspension of booking privileges;
account restrictions; or
termination of the Host’s account.
We may make exceptions for circumstances beyond the Host’s reasonable control.
In certain circumstances outside a user’s reasonable control, we may determine that special cancellation or refund provisions apply.
Such circumstances may include certain:
natural disasters;
government travel restrictions;
declared emergencies;
severe weather events;
public health emergencies; or
other extraordinary circumstances.
Whether a particular circumstance qualifies will depend on the applicable policy, the facts of the situation, and applicable law.
A Host may require a security deposit where permitted by applicable law and disclosed during the booking process.
Guests are responsible for damage they or their invitees cause beyond ordinary wear and tear, subject to applicable law.
If a Host claims that a Guest caused damage, Endless Skyway Cabin may request supporting information, including photographs, receipts, invoices, repair estimates, or other evidence.
Where permitted by law and authorized by the applicable booking terms, we may charge a Guest for qualifying damage or apply an applicable security deposit.
We do not guarantee that every damage claim will be accepted.
Hosts may not enter an occupied property except as permitted by law and the applicable rental agreement, or in circumstances reasonably necessary to address an emergency.
Guests may not interfere with reasonable property maintenance, safety inspections, emergency access, or legally permitted Host access.
Guests should contact appropriate emergency services immediately when facing an emergency.
Endless Skyway Cabin is not an emergency-response service.
Guests and Hosts are responsible for familiarizing themselves with emergency exits, local emergency numbers, property-specific safety information, and applicable rules.
If you become aware of an immediate threat to someone’s safety, contact local emergency services before contacting Endless Skyway Cabin.
Guests and Hosts may be permitted to leave reviews or ratings following a stay.
Reviews must be:
truthful and based on the user’s genuine experience;
relevant to the transaction or accommodation;
non-threatening;
non-defamatory;
free from unlawful discrimination or harassment; and
free from personal information that should not be publicly disclosed.
Users may not manipulate reviews, offer incentives for positive reviews where prohibited, threaten another user over a review, or submit fraudulent reviews.
We may remove content that violates these Terms or applicable law.
You may submit photographs, reviews, comments, descriptions, messages, and other content through the Services (“User Content”).
You retain ownership of User Content that you own.
By submitting User Content, you grant [Company Name] a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, distribute, and use the User Content as reasonably necessary to operate, promote, improve, and provide the Services.
You represent that:
you own or have the necessary rights to submit the content;
the content does not violate another person’s rights;
the content does not violate applicable law; and
the content does not contain unlawful or prohibited material.
The Services, including their software, design, branding, logos, text, graphics, databases, features, and other content provided by Endless Skyway Cabin, are owned by or licensed to Endless Skyway Cabin and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not:
copy;
modify;
reproduce;
distribute;
sell;
license;
reverse engineer;
scrape;
create derivative works from; or
commercially exploit
any portion of the Services without our prior written permission.
The Services may integrate with third-party services, including payment processors, identity-verification providers, mapping services, communication platforms, analytics providers, and other third parties.
Your use of third-party services may be subject to those providers’ separate terms and privacy policies.
Endless Skyway Cabin is not responsible for third-party services that it does not control.
By creating an account or making a reservation, you agree that we may communicate with you electronically regarding:
your account;
reservations;
payments;
customer support;
security;
policy changes; and
other matters relating to the Services.
Where permitted by law, you may also receive promotional communications. You may opt out of promotional communications using the unsubscribe instructions provided.
Our collection and use of personal information is described in our Privacy Policy.
Our Privacy Policy is incorporated into these Terms by reference.
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Endless Skyway Cabin does not guarantee that:
the Services will always be available;
listings will always be accurate;
properties will always be available;
a Host or Guest will fulfill their obligations;
a property will meet a Guest’s expectations;
information provided by users will be accurate;
the Services will be error-free or uninterrupted; or
the Services will be free from harmful components.
Endless Skyway Cabin does not guarantee the condition, safety, legality, suitability, quality, or accuracy of any property or listing unless expressly stated otherwise.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
Using short-term rental accommodations may involve risks, including risks associated with:
property conditions;
stairs, balconies, pools, hot tubs, fireplaces, or other amenities;
animals;
other occupants or visitors;
neighborhood conditions;
transportation;
weather;
recreational activities; and
other circumstances associated with travel or temporary accommodations.
You are responsible for evaluating whether a property and its amenities are appropriate for you and your accompanying guests.
To the maximum extent permitted by applicable law, Endless Skyway Cabin and its officers, directors, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
To the maximum extent permitted by law, our aggregate liability arising from or related to the Services or these Terms will not exceed the greater of:
the amount you paid to Endless Skyway Cabin during the twelve months preceding the event giving rise to the claim; or
$100.
These limitations do not apply to liability that cannot legally be limited or excluded under applicable law.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Endless Skyway Cabin and its officers, directors, employees, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your violation of these Terms;
your use or misuse of the Services;
your User Content;
your violation of another person’s rights;
damage to property caused by you or your invitees;
your violation of applicable law; or
your conduct in connection with a reservation.
Before initiating a formal legal proceeding, you agree to first contact Endless Skyway Cabin and attempt in good faith to resolve the dispute.

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally may be resolved through binding arbitration rather than in court.
The arbitration will be conducted by an Arbitration Provider under its applicable rules.
The arbitrator, rather than a court, will generally determine disputes subject to arbitration, except where applicable law provides otherwise.
To the extent permitted by applicable law, you and Endless Skyway Cabin agree that disputes will be resolved individually and not as part of a class, collective, or representative action.
You may not participate in a class action against Endless Skyway Cabin concerning a dispute covered by this provision.
Important: Arbitration and class-action provisions can have significant legal consequences and should be reviewed by qualified counsel before publication.
These Terms will be governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles, except to the extent federal law or mandatory consumer-protection law provides otherwise.
Any court proceedings that are permitted under these Terms will be brought in the applicable courts located in McCurtain County, Oklahoma, unless applicable law requires otherwise.
We may suspend or terminate your account or access to the Services if we reasonably believe that:
you violated these Terms;
you violated applicable law;
your account presents a security or fraud risk;
your conduct threatens other users or the Services;
you provided false or misleading information; or
termination is otherwise reasonably necessary to protect Endless Skyway Cabin, its users, or third parties.
You may stop using the Services at any time.
Termination does not automatically eliminate obligations that arose before termination.
We may modify, suspend, or discontinue portions of the Services at any time.
We may add, remove, or change features, functionality, fees, or requirements.
Where required by law, we will provide notice of material changes.
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date.
If we make material changes, we may provide additional notice as required by applicable law.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including:
natural disasters;
fires;
floods;
severe weather;
epidemics or pandemics;
war;
terrorism;
civil unrest;
governmental actions;
labor disputes;
infrastructure failures;
internet or telecommunications failures; or
other extraordinary circumstances.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
These Terms, together with our Privacy Policy and any additional terms expressly incorporated into the Services, constitute the agreement between you and Endless Skyway Cabin concerning your use of the Services.
If there is a conflict between these Terms and a separate agreement applicable to a specific transaction, the terms of the specific agreement will control to the extent of the conflict.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign these Terms, in whole or in part, without your consent in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.
